On September 2, 2020, the United States Trade Representative (USTR) office announced the extension of certain product exclusions to Section 301 List 4A products currently subject to a 7.5% tariff in Federal Register Notice 85 No. 171 FR 54616.
This notice includes 14 complete Harmonized Tariff Schedule (HTS) numbers and 73 specific product descriptions. Companies are encouraged to refer to the Annex in the notice to determine if any of their products are included in the specifically identified exclusion extensions. The scope of each exclusion extension is governed by the 10-digit level HTS numbers and the descriptions identified in the notice. It is important to note that these exclusions are available for any product that meets the description in the official notice, regardless of whether the importer filed an exclusion request. If you import products that are consistent with these descriptions, you will be able to claim an exclusion extension using HTS# 9903.88.57 effective September 1, 2020.
This notice covers the extension review of all 8 List 4A – $300B exclusion notices issued as follows:
- 85 FR 13970 (March 10, 2020)
- 85 FR 15244 (March 17, 2020)
- 85 FR 17936 (March 31, 2020)
- 85 FR 28693 (May 13, 2020)
- 85 FR 35975 (June 12, 2020),
- 85 FR 41658 (July 10, 2020)
- 85 FR 44563 (July 23, 2020)
- 85 FR 48627 (August 11, 2020).
These exclusion extensions will go into effect on September 1, 2020 and expire on December 31, 2020.
All other exclusions not granted extensions as noted in the Annex to the Federal Register notice expired on September 1, 2020 as originally scheduled and will be subject to the 7.5% Section 301 Tariffs.
