On Wednesday March 23, the United States Trade Representative (USTR) office announced in a Press Release a decision to reinstate certain previously granted and extended product exclusions from the China Section 301 Tariffs. The determination reinstates 352 of 549 eligible exclusions. The full list can be found in the Notice of Reinstatement of Certain Exclusions: China’s Acts, Policies, and Practices
This notice include 33 complete HTS and 319 specific product descriptions. Companies are encouraged to refer to the Annex in the notice to determine if any of your products are included in the list of exclusions. The scope of each exclusion is governed by the 10-digit level Harmonized Tariff Schedule (HTS) numbers and the descriptions identified in the notice. It is important to note that these exclusions are available for any product that meets the description in the official notice, regardless of whether the importer filed an exclusion request.
The exclusions will be enforced as follows:
- Retroactive Effective Entry Date: October 12, 2021
- End Entry Date: December 31, 2022
- Exclusions HTS: 9903.88.67
Retroactive refunds of the Section 301 tariffs will not be automatic. Importers must submit a post-summary correction (PSC) for eligible entries made subsequent to the dates noted above. If entries have already liquidated, importers may follow liquidation protest rules.
