CHINA TARIFFS: USTR TO EXTEND SECTION 301 EXCLUSIONS FOR COVID-19 MEDICAL-CARE PRODUCTS

On December 29, 2020, the United States Trade Representative (USTR) office announced in Federal Register Notice 85 No 249 FR 85831 the extension of section 301 exclusions to twenty-four (24) medical-care products needed to address the COVID-19 outbreak.

This notice includes 24 complete Harmonized Tariff Schedule (HTS) numbers. Companies are encouraged to refer to the Annex in this notice to determine if any of their products are included in the specifically identified exclusion extensions. The scope of each exclusion extension is governed by the 10-digit level HTS numbers and the descriptions identified in the notice. It is important to note that these exclusions are available for any product that meets the description in the official notice, regardless of whether the importer filed an exclusion request. If you import products that are consistent with these descriptions, you will be able to claim an exclusion extension using HTS# 9903.88.62 effective January 1, 2021.

These exclusion extensions will go into effect on January 1, 2021, and expire on March 31, 2021.
